In responce to your picking of nits (much love to you too), I raise a question: Why is any so-called underground film considered 'underground'?
Because it differs from the usual way that films are made, stylistically and thematically. In other words, it goes places where most films (Studio or Independent) would never dare to go in fear of offending people, not becoming a bankable investment, or whatever.
I made a short movie about the true connection between the Shower Scene in Hitch's PSYCHO & people getting freaked out and paranoid in their own showers because of it, even to this day. It has no dialogue (only title cards explaning the mental state & thoughts of the character) and the soundtrack is comprised of original industrial music merged with a slowed-down rendering of Herrman's famous score.
It breaks many generally accepted rules of mainstream/indie cinema & uses it to its advantage in a new way. That's underground enough for me.

Most festivals prefer to have stuff which is a bit different. Surely you'd stand more chance getting it in. If you're trawling through the same shit day after day and come across something which is original surely you going to pick it out.
Give it a try, it's the only way to know whether they'll accept it or not.
